NSW rules

Sharing a fence with a neighbour

  • Under the NSW Dividing Fences Act 1991, adjoining owners are usually liable to contribute equally to a sufficient dividing fence.
  • To start, give your neighbour a fencing notice setting out the proposed work, who you suggest does it and the estimated cost.
  • If you can't agree within one month, either owner can apply to the Local Court (and some matters go to NCAT) to decide.
  • A neighbour can limit their contribution to a sufficient dividing fence for the area, so if you want something dearer you may pay the difference. Talk it over first, ideally in writing.

From Dividing Fences Act 1991 (NSW) (checked 18 Oct 2026). A guide, not legal advice: check the source before you rely on it.
